1. About the ATS Health Checker

The ATS Health Checker is a diagnostic and prioritisation tool provided by TAOps Consulting. It is designed to help organisations evaluate how effectively their Applicant Tracking System (ATS) supports their hiring processes, and to identify prioritised, practical improvements.

By accessing or using the ATS Health Checker, you agree to these Terms of Use. If you do not agree, please do not use the tool.

Results generated by the ATS Health Checker are based solely on the inputs provided by the user. Outputs reflect likely areas of focus, not definitive conclusions.

TAOps Consulting is not responsible for decisions or actions taken based on the outputs of this tool. Responsibility for implementing any changes remains with the customer organisation.

The tool does not:

• Guarantee specific outcomes from implementing its recommendations
• Certify compliance with any legal or regulatory standard
• Replace professional legal, HR, or technical judgement
• Constitute an audit of any kind

4. Account creation and access

To use the ATS Health Checker, you must create an account with a valid work email address. You are responsible for:

• Keeping your login credentials secure and confidential
• All activity that occurs under your account
• Ensuring your account is not shared between individuals

TAOps Consulting reserves the right to suspend or terminate accounts that violate these Terms.

5. Acceptable use

The ATS Health Checker must not be used to:

• Evaluate individual recruiter or employee performance
• Audit individuals or teams for disciplinary purposes
• Certify compliance or regulatory readiness
• Substitute for legal, HR, or technical professional advice
• Process or input candidate-level personal data

It is intended to support prioritisation, planning, alignment, and informed decision-making at an organisational level.

6. Data and privacy

The ATS Health Checker does not request or process candidate-level personal data. All inputs are based on organisational configuration, process descriptions, and governance awareness.

Assessment results are stored to support report generation, progress comparison for follow-up checks, and customer access to historical outputs. Data is retained only for the duration required to deliver the selected package.

You may request deletion of your assessment data at any time by contacting TAOps Consulting.

7. Consulting services

Where the tool suggests consulting support from TAOps Consulting, this is optional and non-binding. Consulting recommendations are based on diagnostic findings and are intended to support execution, not mandate action.

Any consulting engagement is subject to a separate agreement and is not governed by these Terms of Use.

8. Intellectual property

The ATS Health Checker, including its diagnostic framework, question bank, scoring logic, and output formats, is the intellectual property of TAOps Consulting. You may not reproduce, distribute, or resell any part of the tool or its outputs without written permission.

9. Limitation of liability

To the fullest extent permitted by law, TAOps Consulting shall not be liable for any indirect, incidental, or consequential damages arising from your use of the ATS Health Checker or reliance on its outputs.

10. VAT and Tax

All prices are exclusive of VAT (BTW) unless otherwise stated.

For customers in the Netherlands, VAT will be charged at the applicable Dutch rate (currently 21%).

For EU business customers with a valid VAT number, VAT will be reverse-charged in accordance with Article 196 of the EU VAT Directive.

For EU consumers, VAT may be charged at the rate applicable in your Member State.

For customers outside the EU, no EU VAT is charged.

11. Changes to these terms

TAOps Consulting may update these Terms of Use from time to time. Continued use of the tool after changes are published constitutes acceptance of the updated terms.

12. Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles.
